Terms of Service

These Terms of Service (“Terms”) govern your access to and use of websites, browser experiences, and related services operated by CheerAI LLC (“we,” “us,” or “CheerAI”), including without limitation Game Anything at gameanything.com, together with games, mini-games, creator tools, and add-ons offered there or linked from there (collectively, the “Services”).

1. Agreement

By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. The Services

Game Anything is an AI-assisted casual gaming platform: browser-based play, creation tools, and reusable game assets, including games and mini-games made available on gameanything.com. Features, availability, and supported browsers may change without notice.

3. Eligibility and accounts

You must be able to form a binding contract in your jurisdiction to use account-based features. If you create an account, you are responsible for safeguarding your credentials and for activity under your account. Notify us promptly of unauthorized use if contact methods are provided on the Services.

4. Acceptable use

You agree not to misuse the Services, including by: violating law; attempting to gain unauthorized access to systems, data, or accounts; interfering with or disrupting the Services; using the Services to distribute malware or harmful code; harassing others; scraping or automated access that unreasonably loads our infrastructure; or circumventing technical limits or paywalls where applicable.

We may suspend or terminate access for conduct we reasonably believe violates these Terms or harms the Services or other users.

5. User content and creations

If you upload, generate, or submit content (including maps, levels, sprites, text prompts, or other materials) through creator tools or community features, you retain ownership of your content to the extent you hold rights in it. You grant CheerAI a non-exclusive, worldwide license to host, store, reproduce, display, and distribute your content as reasonably necessary to operate, improve, and promote the Services.

You represent that you have the rights needed to grant the above license and that your content does not violate law or third-party rights.

6. Intellectual property

The Services, including branding, graphics, game design (where not user-submitted), software, and documentation, are owned by CheerAI or its licensors and are protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights are granted to you.

7. Third-party services

The Services may link to or integrate third-party sites, ads, analytics, or platforms (for example, Google Analytics or Google Tag Manager). Those third parties’ terms and privacy policies apply to your interactions with them.

8. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHEERAI DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHEERAI AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL CHEERAI’S AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICES EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (US $50), IF YOU HAVE NOT PAID US ANYTHING.

10. Indemnity

You will defend, indemnify, and hold harmless CheerAI from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your content, your use of the Services, or your violation of these Terms or applicable law.

11. Changes

We may modify these Terms or the Services. We will post updated Terms on this page and may update the “Last updated” date. Continued use after changes constitutes acceptance of the revised Terms where permitted by law.

12. General

These Terms are governed by the laws of the State of Delaware, USA, excluding conflict-of-law rules, unless mandatory consumer protections in your jurisdiction require otherwise.
